Estos Términos y Condiciones de Uso ("Términos") se celebran entre tú y Aluna Colombian Culture LLC, una sociedad de responsabilidad limitada del estado de Florida, Estados Unidos ("Aluna", "nosotros", "nuestro"). Al usar y acceder a este sitio web y a los servicios de venta por teléfono de Aluna (los "Servicios"), aceptas estos Términos, así como cualquier modificación que Aluna emita y todas las leyes y regulaciones aplicables.

These Terms & Conditions of Use ("Terms") are entered into between you and Aluna Colombian Culture LLC, a limited liability company organized under the laws of the State of Florida, United States ("Aluna", "we", "us", "our"). By using and accessing this website and Aluna's sales-by-phone services (the "Services"), you agree to these Terms, as well as to any modifications Aluna may issue and to all applicable laws and regulations.

BY USING THE SERVICES, YOU AGREE AND SHALL BE DEEMED TO BE BOUND BY THESE TERMS AND OTHER APPLICABLE POLICIES. If you do not wish to be bound by these Terms or policies, do not use the Services.

Aluna se reserva el derecho, en cualquier momento y sin previo aviso, a su entera discreción, de revisar estos Términos o de imponer nuevas condiciones con respecto al acceso o uso de los Servicios. Dichas revisiones y adiciones serán efectivas de inmediato al publicarse en los Servicios. Eres responsable de revisar estos Términos periódicamente. Aluna reserves the right, at any time and without prior notice, in its sole discretion, to revise these Terms or to impose new conditions with respect to access to or use of the Services. Any access to or use of the Services after notice of revisions or additions shall constitute your acceptance of such revisions or additions.

Estos Términos son efectivos hasta que Aluna los termine. Aluna puede terminarlos sin previo aviso y en cualquier momento con respecto a cualquiera de los Servicios. En caso de terminación, dejarás de estar autorizado a acceder a esos Servicios, y las restricciones impuestas sobre ti con respecto al contenido, y las exenciones, indemnizaciones y limitaciones de responsabilidad establecidas en estos Términos sobrevivirán a la terminación.

These Terms are effective until terminated by Aluna. Aluna may terminate them without prior notice and at any time with respect to any of the Services. Upon termination, you shall no longer be authorized to access those Services, and the restrictions imposed on you with respect to content, and the disclaimers, indemnities and limitations of liability set forth in these Terms shall survive termination.

Aceptas cumplir con todas las leyes, estatutos, ordenanzas y regulaciones aplicables respecto de tu uso de los Servicios y tu compra de productos a través de ellos. Debes tener al menos 18 años para usar los Servicios.

Todos los precios mostrados en los Servicios están expresados en dólares estadounidenses (USD). Aluna puede, a su discreción, limitar la entrega a direcciones dentro de los Estados Unidos y Colombia. Aluna añadirá los gastos de envío y manipulación y el impuesto sobre las ventas aplicable. Los envíos a Colombia se despachan desde nuestro taller en Colombia y los gastos de aduana y aranceles corren por cuenta de Aluna. Los productos y servicios ofrecidos en este sitio están disponibles mientras haya existencias.

La recepción de una confirmación de pedido no constituye la aceptación del pedido por parte de Aluna. Antes de la aceptación de un pedido, puede requerirse la verificación de la información y la aprobación del mismo. Aluna se reserva el derecho, en cualquier momento después de la recepción de tu pedido, de aceptar o rechazar tu pedido, o cualquier parte del mismo, incluso después de la recepción de una confirmación, por cualquier motivo. Aluna se reserva el derecho de limitar la cantidad de pedido de cualquier artículo y de rechazar el servicio a cualquier cliente sin previa notificación.

El pago se realiza a través de la pasarela de pago Square. Al tratarse de un tercero, Square gestiona de forma segura los datos de tu tarjeta; no almacenamos los datos de tu tarjeta en nuestros sistemas. A los pedidos se les aplicará el impuesto sobre las ventas (sales tax) vigente en Florida.

All prices displayed on the Services are expressed in U.S. dollars (USD). Aluna may, at its discretion, limit delivery to addresses within the United States and Colombia. Aluna will add shipping and handling charges and applicable sales tax. Shipments to Colombia are dispatched from our workshop in Colombia, and customs duties and tariffs are covered by Aluna. Products and services offered on this site are available while supplies last.

Receipt of an order confirmation does not constitute Aluna's acceptance of the order. Verification of information and approval may be required before acceptance of an order. Aluna reserves the right, at any time after receipt of your order, to accept or reject your order, or any part of it, even after receipt of a confirmation, for any reason. Aluna reserves the right to limit the order quantity of any item and to refuse service to any customer without prior notice.

Payment is processed through the Square payment gateway. As a third party, Square securely handles your card data; we do not store your card data in our systems. Applicable Florida sales tax will be added to orders.

IN NO EVENT WILL ALUNA, ITS SUPPLIERS OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, WHETHER IN CONTRACT OR IN TORT, INCLUDING NEGLIGENCE, ARISING IN ANY WAY FROM ACCESS TO OR USE OF, OR THE INABILITY TO ACCESS OR USE, ANY OF THE SERVICES OR ANY LINKED SITE OR ITS CONTENT.

Aluna ofrece joyería artesanal de inspiración precolombina colombiana. Las piezas se elaboran a mano en Colombia con peltre o bronce con 2 baños de oro de 24K, así como con piedras naturales y esmeralda cruda. Al ser piezas hechas a mano, cada una es única: los materiales, dimensiones y características específicas de cada joya se describen en su ficha técnica correspondiente y pueden variar ligeramente de una pieza a otra.

Todas nuestras joyas cuentan con garantía por defectos de fabricación. La garantía no cubre daños ocasionados por el uso inadecuado, golpes, caídas, exposición a productos químicos ni el desgaste natural de la pieza con el paso del tiempo. EXCEPTO LO EXPRESAMENTE INDICADO EN EL PRESENTE DOCUMENTO, ALUNA RENUNCIA EXPRESAMENTE A TODAS LAS DEMÁS GARANTÍAS, EXPRESAS O IMPLÍCITAS, DE CUALQUIER TIPO. Aluna offers handmade jewelry inspired by Colombian pre-Columbian heritage. Pieces are handcrafted in Colombia in pewter or bronze plated in 24k gold, as well as with natural stones and raw emerald. Since pieces are handmade, each one is unique: the specific materials, dimensions and characteristics of each piece are described in its corresponding technical sheet and may vary slightly from piece to piece.

All of our pieces are covered by a manufacturing warranty. The warranty does not cover damage caused by improper use, knocks, drops, exposure to chemicals, or natural wear over time. ALUNA MAKES NO REPRESENTATION OR WARRANTY WHATSOEVER WITH RESPECT TO ANY PRODUCT OR SERVICE SOLD. IN NO EVENT SHALL ALUNA'S LIABILITY EXCEED THE PRICE YOU PAID FOR THE PRODUCT OR SERVICE THAT IS THE SUBJECT OF THE CLAIM.

Aceptas defender, indemnizar y eximir de responsabilidad a Aluna, a sus proveedores y a sus afiliadas y entidades relacionadas y a sus respectivos directivos, funcionarios, empleados y agentes, de y contra todas las reclamaciones, pérdidas, daños, responsabilidades y costos (incluidos, sin limitación, los honorarios razonables de abogados y costas judiciales) que surjan de o se relacionen con tu incumplimiento de estos Términos o tu acceso o uso de los Servicios.

You agree to defend, indemnify and hold harmless Aluna, its suppliers and its affiliates and related entities and their respective directors, officers, employees and agents, from and against all claims, losses, damages, liabilities and costs (including, without limitation, reasonable attorneys' fees and court costs) arising out of or relating to your breach of these Terms or your access to or use of the Services.

Salvo que se disponga expresamente lo contrario en estos Términos o en la Política de Privacidad, cualquier comunicación o material que transmitas a Aluna a través de los Servicios por correo electrónico o de otro modo, incluidas, entre otras, imágenes, fotografías, preguntas, comentarios, sugerencias o similares, se tratará como no confidencial y no propietario y podrá ser utilizado por Aluna, incluida, entre otras, su reproducción, modificación, divulgación, transmisión, publicación y publicación, y para fines publicitarios, de promoción o publicitarios en cualquier medio sin necesidad de permiso, consentimiento, pago u otra consideración adicional, salvo que la ley lo prohíba. In addition, Aluna is free to use any ideas, concepts, know-how or techniques contained in any communication you send us for any purpose.

Estos Términos constituyen el acuerdo completo de las partes con respecto a su objeto. La falta de renuncia por parte de Aluna a cualquier incumplimiento no se considerará una renuncia a ningún incumplimiento anterior o posterior. Si cualquier disposición de estos Términos fuera ilegal, nula o, por cualquier razón, inaplicable, dicha disposición se considerará separable de los Términos y no afectará a la validez y aplicabilidad de las demás disposiciones.

Aluna no será responsable de ningún incumplimiento o retraso en el cumplimiento causado por cualquier acto ajeno a su control razonable, incluidos, entre otros, actos u omisiones de terceros, indisponibilidad de suministros, fallos de equipos, guerras, huelgas, cierres patronales, incendios, inundaciones o cualquier otro caso fortuito, cualquier ley, regulación u ordenanza, o los retrasos, indisponibilidad, errores u otros fallos de internet u otras redes de datos.

Estos Términos se rigen por las leyes del estado de Florida, sin considerar sus disposiciones sobre conflicto de leyes. La jurisdicción exclusiva para cualquier acción o procedimiento que surja de o se relacione con estos Términos, el uso de los Servicios o cualquier pedido realizado o producto comprado a través de ellos será la de los tribunales estatales o federales ubicados en el estado de Florida.

These Terms constitute the entire agreement of the parties with respect to their subject matter. Aluna's failure to enforce any breach shall not be deemed a waiver of any prior or subsequent breach. If any provision of these Terms is illegal, void or, for any reason, unenforceable, such provision shall be deemed severable from the Terms and shall not affect the validity and enforceability of the remaining provisions.

Aluna shall not be liable for any failure or delay in performance caused by any act beyond its reasonable control, including, without limitation, acts or omissions of third parties, unavailability of supplies, equipment failures, wars, strikes, lockouts, fires, floods or any other force majeure event, any law, regulation or ordinance, or delays, unavailability, errors or other failures of the internet or other data networks.

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws provisions. The exclusive jurisdiction for any action or proceeding arising out of or relating to these Terms, the use of the Services or any order placed or product purchased through them shall be the state or federal courts located in the State of Florida.
